How to use this template

6 steps from download to use.

  1. 01Confirm the workplace is NSW-domiciled and the employee will perform work principally in NSW.
  2. 02Replace the employer-name, ABN, and signatory placeholders.
  3. 03Set the role, reporting line, work pattern, and compensation.
  4. 04Confirm the modern award or enterprise agreement that applies; the contract floors against it.
  5. 05Confirm the long-service-leave clause matches your accrual practice (NSW LSLA: 2 months at 10 years, with 1 month at 5 years for pro-rated entitlement on termination).
  6. 06Have employment counsel review before issuing.
When to use this template

The right document at the right moment.

Use this contract for permanent hires in NSW workplaces. The leave clauses reference the NSW Long Service Leave Act; the governing-law clause names NSW courts. For other states use the equivalent state-specific contract.

For casual or fixed-term NSW hires, use the casual or fixed-term contract and edit the governing-law clause to NSW. The body of those contracts is jurisdiction-neutral.

FAQ

Honest answers before you download.

How is NSW different from VIC or QLD?
Long-service-leave entitlements vary by state — NSW is governed by the Long Service Leave Act 1955 (NSW) with 2 months at 10 years. VIC, QLD, and other states have their own Acts with different accrual and pro-rated entitlements. The contract references the correct Act for NSW; use the equivalent state contract for other jurisdictions.
What about Fair Work?
The Fair Work Act 2009 (Cth) applies federally and sets the minimum entitlements (annual leave, personal leave, parental leave). State long-service-leave law sits on top of the federal floor.
Are non-competes enforceable in NSW?
Yes, where reasonable in scope and duration. NSW courts apply a reasonableness test on activity, geography, and duration. 6 to 12 months is the typical defensible range; longer requires strong justification.
